MEC x Crag X Climb Giveaway 2024 - Contest Rules (the “Contest”) is governed by the following rules (the “Official Rules”). By participating or attempting to participate in the Contest, you will be deemed to have received, understood, and agreed to these Official Rules.

Although the Contest may be promoted, communicated, or administered by means of a third party, including but not limited to a social media or social networking service or site (a “Third Party Service”), the Contest is not sponsored, endorsed, administered by or associated with any Third Party Service. For greater clarity, Third Party Services include but are not limited to the following: Instagram, Twitter, Pinterest, LinkedIn and Facebook. The Contest is sponsored and administered by MEC Mountain Equipment Company Ltd.

Any questions, comments or complaints regarding the Contest should be directed to MEC and not to any Third Party Service.

1. ELIGIBILITY?
The Contest is open only to residents of Canada who have reached the age of majority in their jurisdiction of residence as of the date of entry.

The following individuals are not eligible to enter the Contest:
a) employees, officers, and directors of: (i) MEC; and (ii) any prize suppliers;
b) a household member of any of the individuals listed in (a) above; and c) members of the immediate family (spouse, parent, child, sibling) of the individuals listed in (a), above;

2. WHEN DOES THE CONTEST BEGIN/END?
The Contest begins at 12:00 PM Pacific Time on March 20 2024, and runs until 11:59 PM Pacific Time on November 23 2024 (“Entry Period”). During each day of the Entry Period, eligible individuals will be able to enter to win the prizes set out at the bottom of these Official Rules (the “Prizes”)

3. HOW DO I ENTER THE CONTEST?
No purchase is necessary to enter the Contest.
To enter the Contest:

  1. Visit Crag X during one of the following events: (i) Spring Fling Comp Thing in Victoria on March 20 - April 20, 2024; or (ii) Highballathon event in Victoria on November 17 - 23, 2024;
  2. Scan the QR code on the 'Enter to win' sign;
  3. Fill out the details required on the form;
  4. Press the 'Submit' button;

You are solely responsible for ensuring that your entry or entries are properly submitted (including by properly completing any required registration fields).

You must only submit one entry, and MEC may disqualify you from the Contest if MEC receives multiple entries from you.

4. COULD MY ENTRY BE REFUSED OR REJECTED?
Your entry could be refused or rejected if:

a) you fail to meet the Contest’s eligibility criteria;
b) you attempt to enter the Contest in a manner not authorized by these Official Rules;
c) your entry contains false or misleading information, or is late, falsified, illegible, or incomplete or otherwise irregular;
d) your entry is submitted using robotic, automated, programmed, or other illicit means; or
e) your entry is not in compliance with these Official Rules.

In addition, MEC reserve the right to refuse any entry for any other reason in its sole discretion.

5. WHAT ARE THE ENTRY CONDITIONS and HOW DO THE RELEASEES LIMIT THEIR LIABILITY?
By entering the Contest:

a) you agree to be bound by these Official Rules and by the decisions of MEC, which decisions are final;
b) you agree that MEC shall have the right at any time to require proof of identity or eligibility to enter the Contest; failure to provide any such proof upon request may result in disqualification;
c) you release and forever discharge MEC, its respective affiliates, and subsidiaries, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns, as well as any Third Party Services, (collectively, the “ Releasees”), and agree to indemnify and hold harmless each of the Releasees, from and against any and all claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, arising out of, or in any way related to, (i) your participation in, or inability to participate in, the Contest, (ii) the awarding, receipt, possession, use, redemption or misuse of any prize, in whole or in part, or activity related to any prize, or your inability to receive, use or redeem any prize; (iii) your failure to comply with these Official Rules, or (iv) any breach of these Official Rules.

MEC will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the Contest or these Official Rules.

6. ARE THERE ANY PRIZE CONDITIONS?
In addition to any prize conditions provided elsewhere in these Official Rules, any prize awarded in the Contest is subject to the following conditions:

a) The prize must be accepted as awarded, will be awarded to the confirmed winner only, and is not transferable, resellable or redeemable for cash.
b) MEC reserves the right to substitute any prize in whole or in part in the event that all or any component of the prize is unavailable, with a prize of equal or greater retail value.
c) MEC does not make any representation or warranty, expressed or implied, regarding the quality or characteristics of the prize.

Any winner is solely responsible for coordinating use of any prize and for all taxes, fees, and expenses not otherwise set forth herein. Prizes may be subject to additional terms and conditions as imposed by prize suppliers.

7. HOW WILL THE POTENTIAL WINNER(S) BE SELECTED?
On the following dates, MEC will conduct 1 random draw corresponding to each of the Prizes from among all eligible entries received, starting on the following dates:

  • April 26 2024 beginning at 12:00 PM PT in Victoria, British Columbia (corresponding to entrants from the Spring Fling Comp Thing contest);
  • November 30 2024 beginning at 12:00 PM PT in Victoria, British Columbia (corresponding to entrants from the Highballathon contest).

For each of the Prizes to be awarded pursuant to these Official Rules, one entrant will be randomly selected as a potential winner and notified using the information provided at the time of entry. If any potential winner does not respond to such notification within three (3) business days, declines a prize for any reason, or does not meet the requirements set forth in these Official Rules, as determined by MEC, the potential winner will be disqualified and, at MEC’s discretion, an alternate potential winner may be randomly selected from among remaining eligible entries, or the prize may be cancelled.

8. HOW CAN A POTENTIAL WINNER BECOME A WINNER?
To be declared a winner, a potential winner:

a) must correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered by MEC;
b) must comply with these Official Rules;
c) must sign and return, within any designated time period, any documentation as reasonably required by MEC, which may include a standard release of liability and consent to publicity form; and
d) may be required to provide proof of identification to confirm eligibility or to claim a prize.

9. WHAT ARE THE ODDS OF WINNING A PRIZE?
The odds of winning depend on the number of eligible entries received.

10. HOW DO I CLAIM A PRIZE?
Once a potential winner is confirmed as a winner, prize distribution will be promptly coordinated. Except as otherwise indicated by MEC, a winner must personally take delivery of the prize as instructed within thirty (30) days of being notified that such prize is available or within such other time period as may reasonably be advised. If a winner fails to take delivery of the prize as instructed, the prize will be deemed forfeited.

11. WILL I APPEAR IN ANY PUBLICITY IF I AM A WINNER?
If you are a winner, MEC may require you to appear in publicity related to the Contest or to any similar contest. By entering the Contest, you consent to MEC’s use of your name, home town, photograph, voice and/or image for promotional and publicity purposes in all media used by MEC, without further notification, permission, payment or consideration.

12. HOW WILL MY PERSONAL INFORMATION BE COLLECTED, USED AND DISCLOSED?
By entering the Contest, you consent to MEC’s collection, use and disclosure of your personal information in accordance with the Privacy Policy, available at https://www.mec.ca/en/explore/privacy-policy (the “MEC Privacy Policy”), for purposes of administering the Contest as described in these Official Rules or as otherwise required or permitted by applicable law.

13. WHAT LAWS APPLY TO THE CONTEST?
The Contest and these Official Rules are governed by the laws applicable in British Columbia. Any disputes, claims or causes of action arising out of or connected with the Contest, prize or these Official Rules will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of British Columbia, Canada.

14. CAN MEC CANCEL OR AMEND THE CONTEST?
MEC may cancel, modify, or suspend the Contest or amend these Official Rules for any reason without prior notice. For example, if for any reason the Contest is not capable of running as originally planned, MEC may adjust any of the dates, timeframes or other Contest mechanics, or suspend or cancel the Contest.
You may not amend these Official Rules in any way.

15. WOULD MEC EVER DISQUALIFY OR BAN SOMEONE FROM A CONTEST?
MEC may disqualify without notice or ban someone from the Contest or any future contest for any other reason, including if MEC find that a person has:

a) resold or attempted to resell a prize, in whole or in part;
b) tampered with or attempted to tamper with, or undermined or attempted to undermine, the legitimate operation of the Contest;
c) provided false or misleading information;
d) acted in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any person; or
e) otherwise violated these Official Rules.

16. WHAT HAPPENS IF THESE OFFICIAL RULES CONTRADICT OTHER CONTEST MATERIALS?
In the event of any discrepancy or inconsistency between these Official Rules and disclosures or statements made by MEC or appearing in other Contest-related materials, these Official Rules shall govern.

17. PRIZES
The prizes available to be won in this Contest are as follows. One winner will be selected from the entries received from the Spring Fling Comp Thing in Victoria. The second winner will be selected from the entries received from the Highballathon event in Victoria.
